MyCare Terms and Conditions

Becoming a Member

MyCare Rewards Program is part of the LoyaltyOne Program (‘Program’). A person may become a member of the Program if they are over 18 years old and have a current Australian residential address by completing and returning this application form and being issued with a membership card (‘Card’). In applying for and/or using the Card the person agrees to be bound by these terms and conditions, including any variation to them from time to time. Only a natural person may become a Member of the Program. The Program is operated and managed by Intellipharm ABN 92 001 235 374 (‘Manager’), 11/10 Depot Street, Banyo 4014. The Manager may refuse to accept a person as a Member of the Program at its discretion. The Member’s existing membership of any other loyalty program with a LoyaltyOne participating pharmacy will be cancelled immediately on acceptance of the Member’s application to join the Program. Membership is free, but we reserve the right to charge for replacement or additional cards. Using the Card constitutes acceptance of these Terms and Conditions. You may terminate your membership at any time for any reason by contacting the Manager.

Earning Points

The Card can be used by Members to earn Points by presenting it when purchasing non-prescription items and non-exempt items at any pharmacy participating in the MyCare Rewards/LoyaltyOne program. Exempt items are Pharmacy Only, Pharmacist Only, Prescription medicines, items already discounted or as otherwise stated by Emslie’s Floreat Pharmacy. The MyCare Rewards/LoyaltyOne system will issue the Member the applicable points (as specified by Emslie’s Floreat Pharmacy) for every $1.00 spent on non-prescription and non-exempt items. Points earned do not expire. Points cannot be earned on prescription items or exempt items unless otherwise stated. Bonus Points may be earned from time to time in relation to special promotions of particular goods or services as advertised from time to time by Emslie’s Floreat Pharmacy. Any points issued as a result of fraud, dishonesty or error, or that relate to a purchase by the Member that is subsequently cancelled or refunded, will be cancelled by the Manager. Points and any benefit that they confer are not property, do not have any cash or monetary value and cannot be sold, transferred, assigned or otherwise dealt with otherwise than in accordance with these terms and conditions. The Card is not a credit card or charge card, is not transferable, and remains the property of the Manager. Members must notify the Manager if they change their address or if the Card is lost or stolen. ‘Exempt items’ are items that are exempt from earning Points when purchased as advertised by Emslie’s Floreat Pharmacy or the Manager from time to time.

Using Points

If a Member wishes to redeem an amount of Points, the Member can do so in part or full payment for items up to the amount of Points balance available on their card. Points cannot be redeemed for cash and may only be used in whole and not in part. No cash refund will be made where the Points balance on the Card exceeds the price of the items purchased. Points can only be used by the Member to whom it is issued.

Privacy

The site www.loyaltyone.com.au (which MyCare Rewards is a part of) may include third party content which is subject to that third party’s terms and conditions. Nothing on the site should be construed as granting any licence or right for you to use that content. The Member consents to the Member’s Pharmacy and the Manager collecting information concerning the Member (including information contained in the application form and information concerning the Member’s Points balance and purchases from Emslie’s Floreat Pharmacy) and making this information available to the Manager’s related bodies corporate, and the Manager’s subcontractors involved in the operation of the Program. The Member consents to this information being used by the Manager and its related bodies corporate and Emslie’s Floreat Pharmacy, for direct and other types of marketing, planning, product development, research and other purposes relating to the Program. Member’s information will be owned by the Member’s Pharmacy and will be dealt with in accordance to the Intellipharm privacy policy at www.loyaltyone.com.au/privacy

Changes to the Program

The Manager may at any time, at its discretion and with or without prior notice to Members, amend these terms and conditions, suspend or terminate the Program or cancel a person’s membership, even if this would: reduce or eliminate the number, value or length of validity of, Points already issued; or result in cancellation of Points already issued. The Manager will use its reasonable endeavours to notify Members of any significant changes to the Program by posting a notice in the Member’s Pharmacy, or by such other means as the Manager may determine, but is not obliged to do so. Neither Emslie’s Floreat Pharmacy nor the Manager will be liable to you for the termination of the MyCare Rewards/LoyaltyOne program for any reason whatsoever, including (without limitation) for any points or cash in your account at the time of termination.

General

The Member acknowledges that: Emslie’s Floreat Pharmacy does not have any authority to make any representation, warranty or statement on behalf of the Manager in relation to the Program; and goods and services supplied upon redemption of a cash voucher are supplied by the Member’s Pharmacy and not by the Manager. Any liability the Manager may have to the Member, including without limitation, any change to, suspension, termination of, the Program, the cancellation of any person’s membership in the Program, or any errors or omissions in recording or issuing of Points and including, without limitation, any liability in negligence, breach of contract or otherwise, and all conditions and warranties as to the condition, suitability, quality, fitness or safety of any goods or services supplied by the Member’s Pharmacy whether express or implied by stature, are excluded to the extent permitted by law, and, where liability cannot be excluded, the Manager’s liability to the Member will in all cases be limited to the cost of re-supplying the goods and services or repairing, or paying the costs of repairing, the goods; or reinstating number of points in dispute. Any tax, liability, or duty incurred by a member arising from a member’s participation in the Program is the responsibility of the Member. Nothing in these Terms and Conditions limits your rights under the Australian Consumer Law.
